Terms of Service

These terms are an agreement between you and Cortexlumora Private Limited, a company registered in India (“Cortexlumora”, “we”, “us”), covering your use of the Calbook app and this website. By creating an account or using Calbook, you accept them. If you do not accept them, please do not use Calbook.

1. Calbook is not medical advice

Calbook is a diary and an estimator, not a medical device. It does not diagnose, treat, cure or prevent any condition, and nothing in the app is medical, nutritional or clinical advice. Calorie budgets, macro targets and weight trends are general estimates, not a prescription.

Talk to a doctor, dietitian or other qualified professional before changing your diet, starting an exercise programme, or acting on anything you see in the app — particularly if you are pregnant, are under medical care, take medication, or have a history of an eating disorder or any other health condition. Never disregard professional advice because of something Calbook showed you. If you think you have a medical emergency, contact your local emergency services.

2. Estimates may be inaccurate

Calbook uses artificial intelligence to turn what you type or photograph into calories, carbohydrate, protein, fat, calories burned, water and weight entries, and to answer questions about your own entries. These outputs are estimates and can be wrong. Portion sizes, home cooking, restaurant meals, mixed dishes, unclear photos and unusual activities are all sources of error, and the model may misread a number on a scale or a screen.

You are responsible for reviewing what the app records. You can edit any entry and adjust its macros yourself, and you should do so when you know better. Do not rely on Calbook where accuracy matters medically.

3. Your account

You need an account to use Calbook, and you must give an accurate email address. You are responsible for keeping access to your account secure and for everything done through it. You must be at least 13 years old to use Calbook. If you are under the age of majority where you live, you may only use Calbook with the consent of a parent or guardian. Tell us promptly if you believe your account has been used without your permission.

The entries, text and photos you put into Calbook remain yours. You grant us a limited licence to store, process and display that content for the sole purpose of operating the service for you — including sending it to our processors as described in the Privacy Policy — and for no other purpose. You confirm you have the right to submit what you submit.

6. Our intellectual property

Calbook, including the app, this website, its design, its name and its logo, is owned by Cortexlumora and protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own personal use. No other rights are granted.

7. Availability and changes

We may change, suspend or discontinue any part of Calbook, and may add or change features, at any time. We may need to take the service down for maintenance. We do not promise that the service will be uninterrupted, error-free, or available in every country.

If we make a material change to these terms, we will update the effective date above and, where the change is significant, tell you in the app or by email. Continuing to use Calbook after that means you accept the updated terms.

8. Termination

You may stop using Calbook and ask us to delete your account at any time by emailing us. We may suspend or terminate your account if you breach these terms, if we are required to by law, or if we discontinue the service. On termination your licence to use the app ends, and your data is handled as described in the Privacy Policy.

9. Disclaimers

To the fullest extent permitted by law, Calbook is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the estimates the app produces are accurate, complete or suitable for any particular purpose.

10. Limitation of liability

To the fullest extent permitted by law, Cortexlumora will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or in connection with your use of Calbook — including any reliance on an estimate the app produced. Our total liability for all claims relating to Calbook is limited to the greater of the amount you paid us for the service in the twelve months before the claim, or one thousand Indian Rupees (₹1,000).

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

11. Indemnity

You agree to indemnify and hold Cortexlumora harmless from any claim or demand, including reasonable legal fees, arising out of your breach of these terms or your misuse of the service.

12. Governing law

These terms are governed by the laws of India, without regard to conflict of law rules. The courts of India shall have exclusive jurisdiction over any dispute arising out of or relating to these terms or to Calbook.

13. General

If any provision of these terms is found unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between you and us about Calbook. You may not assign these terms; we may assign them in connection with a merger, acquisition or sale of assets.
